These terms and conditions (the “Terms and Conditions”) govern the use of https://dronedepot.co.nz (the “Site”). This Site is owned and operated by Drone Depot. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property
All content published and made available on our Site is the property of Drone Depot and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Sale of Goods
These Terms and Conditions govern the sale of goods available on our Site.

The following goods are available on our Site:
UAV’s (Drones); and
UAV Parts & Accessories (Drone Parts & Accessories).

These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Payments
We accept the following payment methods on our Site:
Credit Card; and
Direct Debit.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following methods:

Courierpost (1 – 2 Days).

Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforseen circumstances. Please note that delivery times do not include weekends and statutory holidays.

You will be required to pay delivery charges in addition to the price for the goods you purchase. You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

Drone Depot send every package requiring a signature for insurance reasons. By requesting for the package to be left without a signature, you agree that Drone Depot is not responsible for any loss/damage/theft of your package. 

Warranty

By purchasing any drone products from our Site, you acknowledge and agree to the terms of our warranty. Our warranty covers defects in materials and workmanship for a period of 12 months from the date of purchase. Please note that our warranty does not cover accidental damage, normal wear and tear, or damage caused by misuse or abuse.

In the case of products covered by the manufacturer’s warranty (such as DJI products), the warranty process is subject to their inspection for approval, which may take up to 3-4 weeks. If you need to make a warranty claim for a product covered by the manufacturer’s warranty, we will provide you with instructions on how to initiate the process with the manufacturer. Please note that any shipping or handling fees associated with the warranty claim will be the customer’s responsibility.If you believe that your drone is covered by our warranty and you would like to make a claim, please contact us as soon as possible. We will provide you with instructions on how to return your item to us for repair or replacement.

Please note that any item being returned for warranty repair or replacement must be shipped to our shop at the customer’s expense. We recommend that you use a tracked and insured shipping method to ensure that your item arrives safely. We cannot be held responsible for any damage or loss that occurs during shipping, so please take care to package your item securely.

Second-hand Warranty

In the case of purchasing second-hand drone products from our site, please be aware that the warranty provided is exclusive to the original purchaser and is non-transferable. The second-hand warranty covers manufacturing defects in materials and workmanship for 3 months. It is essential to note that this warranty does not extend to subsequent owners or recipients of the second-hand product.

If you encounter any issues covered by the second-hand warranty, please contact us promptly to initiate the necessary steps for resolution. Keep in mind that any shipping or handling fees associated with the warranty claim will remain the responsibility of the original purchaser.

We appreciate your understanding of the non-transferable nature of the second-hand warranty and encourage you to reach out to us with any questions or concerns regarding your purchase.

Refunds for Goods
Refund requests must be made within 7 days after receipt of your goods.

We accept refund requests for goods sold on our Site for any of the following reasons:

  • Goods are broken.
  • Goods do not match the description.
  • Goods are the wrong size.

Refunds do not apply to the following goods:

  • Sale items.
  • Repair parts.

Returns
Returns can be made either in person at our store or via postage. Please note that return postage costs are the responsibility of the customer.

Consumer Protection Law
Where the Consumer Gurantees Act 1993, the Contract and Commercial Law Act 2017, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability
Drone Depot and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Drone Depot and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of New Zealand.

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Rental Terms and Conditions

Each drone rental is governed by these terms and conditions.

General

By renting equipment from Drone Depot, you acknowledge your understanding of the product and associated software’s usage. You agree to be renting hardware from us, not a help service. You are responsible for testing the equipment and are required to report any faults as soon as they are known so appropriate action can be taken. 

If technical help is required by Drone Depot staff that is outside basic operating conditions, Drone Depot reserves the right to invoice for their time at $60excl. GST per half hour.

Drone Depot reserves the right to check device usage(flight logs) to confirm the device was used for the agreed period of time. If the device was used outside the agreed time, Drone Depot reserves the right to charge at the daily rate.

Bookings

No booking is confirmed until paid for in full or until written confirmation is received from Drone Depot. Written confirmation will typically be in the form of an email advising you that the booking has been confirmed.

Hire period

You agree to return the drone and accessories to Drone Depot within 1 business day before 12pm of the end of the hire period. If the drone and accessories are not returned within 1 business days before 12pm of the end of the hire period Drone Depot reserves the right to continue to charge late return fees until all rental items are returned. You agree that this is a fair way of compensating Drone Depot for the disruption caused to other customers and the normal flow of business.

Late return Fees

A daily charge of $50 will be applied to any rental items with a value under $3000 that are not returned to the shop on their due date. For rental items with a value over $3000, a daily charge of $100 will be applied for each day the item is not returned. These charges will be applied until the rental item is returned to the shop. By renting from our shop, you agree to these terms and conditions regarding out-of-shop days.

If the equipment is hired but not used for any reason, such as a hired drone being rented for a Saturday but unable to be returned on Sunday due to it being outside of our business hours, or for a rental that spans over a weekend, with the equipment not being used on the days in between, Drone Depot reserves the right to charge 25% of the daily rate for each day the equipment is away but not used, including weekends and outside of business hours returns. It is the responsibility of the renter to make necessary arrangements to return the equipment during our business hours.

Security Deposit

You may be required to pay a deposit for each drone hired. This deposit will be refunded to your nominated New Zealand bank account or credit card on safe return of all drones and accessories.

Terms of payment

Full payment of all hire fees and bond is required before release of the drone and accessories to you. Overdue payments may attract interest at commercial rates. Unpaid invoices may be passed to a collection agency 45 days after the due date of the invoice.

Responsibility for equipment

You are responsible for the drone and accessories from the time they are delivered to you until the time Drone Depot receives them back.

Damage to equipment due to rain

You agree to pay Drone Depot for the repair of any water related damage to the drone caused by flying in and around water or rain. There are moisture indicator stickers placed around our rental equipment to establish if a flight in the rain/around water has taken place.

Damage, modifications, and repair

You agree to pay Drone Depot for the repair of any damage that Drone Depot believes is not normal wear and tear. You will not attempt to modify or repair the drone or accessories under any circumstances. Drone Depot reserves the right to continue to charge hire at the daily rate for each drone/accessory being repaired until all drones and accessories are returned to Drone Depot. You agree that this is a fair way of compensating Drone Depot for the disruption caused to other customers and the normal flow of business.

Liability

You will not hold Drone Depot liable in any event for any damages (including immediate, incidental or consequential damages) or losses you may suffer arising from matters related to the use of the equipment by any person during the period of hire.

Operation

Drone Depot permits you, and only you, to operate the drone/equipment. For any other individual to operate the drone express permission must be sought, and obtained, from Drone Depot in writing. You understand that operation of a drone is legally regulated and as such you agree to abide by all applicable regulations. These regulations include but are not limited to: (a) Flying only in daylight (b) Being able to see the drone with your own eyes at all times (c) Not flying above 120 metres (d) Not flying within four kilometres (4 km) of an airport (e) Not flying above people, property or land without consent from the individual and/or owner The operation of drones is regulated by the Civil Aviation Authority. Confiscation

In the event that the drone is confiscated (e.g by the CAA or NZ Police) you agree to immediately pay Drone Depot for the full replacement value of the drone and accessories. You agree that ownership of the confiscated drone does not pass to yourself. Drone Depot may refund any or all monies paid at their sole discretion on return of the confiscated drone and accessories.

Ownership of equipment

Drone Depot will retain ownership of all drones and accessories at all times.

Cancellation of hire

Drone Depot retains the right to cancel the hire of any or all drones and/or accessories at any time by providing written notice. Hire costs for the remaining hire period will be refunded pro-rata. 

If the customer cancels their rental 12 hours before the rental, or on the day of the rental, even if it’s due to rain or weather conditions, Drone Depot reserves the right to charge 50% of the total rental value due to potential disruptions with other rentals, lost business opportunities, and incurred expenses.

Please note that we always try to be flexible and accommodating with our customers, but last-minute cancellations can have a significant impact on our business. We appreciate your understanding and cooperation.

Freight & courier

You agree to pay Drone Depot to cover the cost of freight from Drone Depot’s Auckland base to your nominated location(s) in New Zealand. You agree to arrange and pay for the cost of return freight to Drone Depot’s nominated address, unless Drone Depot provides a pre-paid courier service. You agree to send the drone and accessories via a courier service that is fully-insured for the value of the drone and accessories using only packaging provided by Drone Depot. Drone Depot will not be held responsible for delays in the courier network; or held responsible for delays resulting from the action or inaction of Drone Depot’s nominated courier service. You agree to pay Drone Depot for any transport caused damages to the hire equipment.
